By accessing or using the website at concreteeaston.com (the "Site"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the Site. Your continued use of the Site following any posted changes constitutes acceptance of those changes.
These terms apply to your use of the Site and to any service agreement you enter into with Easton Concrete. In the event of a conflict between these terms and a signed written contract, the signed contract controls.
Easton Concrete provides concrete contracting services including but not limited to: driveway installation and replacement, patio construction, stamped and decorative concrete, sidewalk installation, garage floors, foundation work, retaining walls, pool decks, concrete steps, flatwork, concrete cutting, and related services. All services are provided in Easton, Massachusetts and surrounding communities at the sole discretion of Easton Concrete.
The Site is informational in nature. Submitting a contact or estimate request form does not create a binding contract or guarantee availability. A service agreement is established only upon execution of a written proposal or contract signed by both parties.
All estimates provided by Easton Concrete - whether by phone, email, or written quote - are based on information available at the time of estimation and are subject to revision following an on-site assessment. Final pricing is confirmed in a written proposal before work begins.
Estimates are typically valid for 30 days from the date of issuance, unless otherwise stated. Material cost changes, unforeseen site conditions, or scope additions discovered during the project may result in a revised quote. Any changes to the agreed scope of work will be discussed with you before additional costs are incurred.
Project scheduling is confirmed upon acceptance of a written proposal and receipt of any required deposit. Start dates are subject to permit processing times, weather conditions, and crew availability.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible by phone or email. Cancellation terms, including any applicable deposit retention, are specified in your written contract. Easton Concrete reserves the right to cancel or reschedule work due to weather, safety conditions, or circumstances beyond our control.
Payment terms are outlined in each written proposal or contract. A deposit may be required before work begins. The remaining balance is typically due upon substantial completion of the project unless otherwise agreed in writing.
Invoices not paid by their due date may be subject to a late fee as specified in the contract. Easton Concrete reserves the right to suspend or withhold services on accounts with outstanding balances. In the event that collection action is required, the customer may be responsible for reasonable collection costs, including attorney fees, to the extent permitted by Massachusetts law.
Easton Concrete will obtain all required municipal building permits for contracted work, unless otherwise agreed in writing. Permit fees are typically included in the project quote; if not, they will be itemized separately. The customer is responsible for ensuring the work area is accessible and that any required approvals from homeowners associations or other governing bodies are obtained prior to the project start date.
Easton Concrete warrants that all work will be performed in a workmanlike manner consistent with applicable industry standards. Specific warranty terms - including duration and what is covered - are set forth in the written contract for each project.
The Site and its content are provided "as is" without any warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be error-free or uninterrupted.
Concrete is a natural material subject to cracking, color variation, and surface change over time, particularly in climates with significant freeze-thaw cycles. Normal concrete characteristics - including hairline cracks, minor surface variations, and color inconsistency - are not defects and are not covered under warranty.
To the fullest extent permitted by Massachusetts law, Easton Concrete shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this Site or from any service provided, even if Easton Concrete has been advised of the possibility of such damages.
In no event shall Easton Concrete's total liability for any claim related to a specific project exceed the amount actually paid by the customer for that project.
If a dispute arises between you and Easton Concrete regarding any service or these terms, the parties agree to first attempt to resolve it informally by contacting us at projects@concreteeaston.com. If informal resolution is not possible within 30 days, either party may pursue resolution through binding arbitration or through the courts of Massachusetts, as applicable.
These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any legal action arising out of these terms or your use of the Site shall be brought in the appropriate courts located in Massachusetts.
